POLICIES AND DISCLAIMERS
Bear in mind, you're working with a self-employed individual, Toan T. Thai (the author), should the status of this entity change in the future, the facts in this section will most certainly have identical effect.
DISCLAIMERS:
1. All services, including graphics and webpages are considered to be the same in terms of their usage and purposes. The words "service" and "work" used in here mean a design, picture, ASP or web page, and in some other cases, it could imply the whole project. The fee applied to each service is based on the amount of time spent, not their usage and purposes.
2. It is your responsibility to make sure the materials used on your website are not copyright infringements, those are including but not limited to photos and textual documents; the author will not use alien materials that are not approved by you. Nevertheless, the author may use royal-free and/or public domain's materials without your consent in his designs.
3. In the event your website is carrying offensive materials inflicting the eyes of others, you will be solely the only party to address such offense to the public or in a court of law.
4. It is necessary that you agree to all the statements presented herein before initiating a business relationship with the author. Statements in this Policies and Disclaimers section are subject to change without prior notice.
POLICIES:
1. All services are provided "as is", in which you preview the work and agree to use it in due time, the author will not be responsible should future complications arise where they may result in loss of business; those problems could either be unintentionally caused by the author while making changes, or by God or any other parties. The author, of course, will help you to fix the problems, a reasonable amount of fee will be applied if the problem(s) is/are not caused by the author.
| a. After setting up the website, shopping system, guestbook,
etc..., besides the effort on the author's side to ensure the stability of his services,
it's your responsibility to test and preview the work, you will only agree to use it if
you feel that the work is acceptable. Then you'll be billed for all the charges,
starting from which time you'll be entitled for a credit within 30 days to change only the
designs that you and the author have not reached an agreement. b. To clarify paragraph (a) further; You'll have a credit to change a certain design (the ones that you and the author have not reached an agreement) in case you don't like the design in terms of appearance and/or text, however, this will only apply to a reasonable amount of changes; should you require a more massive amount of changes and additional elements, the author may apply additional charges. c. Programming materials (such as shopping system, guestbook and message board) subject to the same policies, it is important that you request a trial period to test these internet applications, the moment you agree to use them (or on the due date of your bill) will be exactly the time you hold the author free from all reliabilities regarding any future unexpected errors or damages that may result in loss of businesses. Furthermore, you're required to directly contact your web-hosting company for any server-related problems. In the effort to ensure a bug-free ASP application/page as well as the quality of his service, the author will comply in his own time to fix any internal bugs without additional charges within one year, starting from the setup day of the ASP application and/or page, assuming that no one besides the author has altered the application/page in anyway. You are encouraged to take part in suggesting new features or programming functions. |
2. Should you decide to hack or reverse engineering the coding of any of the internet applications/ASP pages, you may do so, but you will not be allowed to share a hacked version with other parties that don't have a legal copy of the same internet application. The author reserves the right to make use or incorporate the altered code in his future releases. The author does not guarantee the efficiency nor will he support the above action, proceed at your own discretion.
3. After the initial copy of a work is transferred to you or another approved party, either on a disc or server, you're responsible to keep that copy or obtain that copy from the server on your own.
4. Bills are generated the end of every month, that you will receive an invoice for all the work done within the passing month, of which the due date will be 15 days from the day you receive the invoice. This means that the time frame from the day the work was done to the day you receive an invoice could be as short as 15 days to as long as 45 days (on an average of 30 days or so). 5. End. |
